62-year-old man rapes girl (10), takes pornographic pictures

A 62-year-old Concession man is appearing at the Bindura Magistrates Court facing allegation of sexually-abusing his neighbour’s 10-year-old daughter and taking pornographic pictures of her.

The abuse started in 2020 and the man was sold out by the naked pictures of the minor that he kept in his phone.

On November 16, police received a tip-off that the accused had semi-nude photos in his mobile phone involving a learner at a local primary school leading to his arrest.

He appeared before Magistrate Mr Amos Mbobo and is in custody.

The Prosecutor Mr Carson Kuwanda said the 62-year-old man is self-employed as a brick layer.

The court heard that sometime in 2020, the accused person visited the workplace of the complainant’s mother and bought quarry stones.

The complainant was with her mother and he invited her to his house.

When the minor went to the old man’s house he then showed her some photos of his house which were in his mobile phone.

On another date, the complainant was on her way from school when she saw the accused person standing by his door.

He called her into his house and asked her to sit on the sofa.

He pulled up her school uniform and sexually abused her once before giving her a dollar.

He threatened her with death and told her to visit him whenever she wished before releasing her to go to school.

From that day, the minor would occasionally visit the accused and he would sexual abuse her.

The court heard that on November 13, the complainant went again to see the accused person in the morning before going to school.

He gave her his mobile phone to watch pornographic videos and he pulled up the complainant’s uniform and started touching her private parts.

After sexually assaulting her, he started to take pornographic pictures of her private parts while caressing it with his left hand which had an animal wrist band.

He gave her a dollar and let her go.

After the police received the tip off inquiries were made at Dandamera Primary School using the photos to identity the minor.

On November 17, the complainant was interviewed in the presence of the school’s guidance and counselling teacher and she opened up about the abuse.

She described the accused’s left hand which has an animal skin wrist band. She also described his room which she said had no floor, has black leather sofas with cream cushions, a black stove, a white fridge, a big plasma television and white curtains.

This was confirmed by the police on arresting the accused.

Two people appeared in court last Friday for allegedly tendering a fake High Court Order to the police to assist them in getting custody of two minor children.

Gift Phiri (54) and Lois Rodo Madyavanhu (65) appeared before Harare Magistrate Mrs Appollonia Marutya charged with fraud.

The pair was remanded in custody pending a bail ruling today.

The complainant is Diana Eunice Kawenda who is a lawyer.

Prosecutor Mr Takudzwa Jambawu alleged that on November 3, Phiri and Madyavanhu proceeded to ZRP Milton Park in the company of her Legal practitioner Paidamoyo Madondo armed with a High Court order number 0433706 under case number HC4001/23 seeking assistance from the police in executing the court order which was granting Madyavanhu custody of two minor children who were staying in Belvedere, Harare.

The court heard that Sergeant Misho of ZRP Milton Park accompanied them to Belvedere for the execution of the court order.

Upon arrival at the house, they met Lucy Kawenda who was staying with the two minor children and they showed her the court order.

Sergeant Misho interrogated her and contrary to what has been said by the accused persons, the two minor children were given to Lucy and George Kawenda by the Social Welfare.

Lucy then called her legal representative Diana Eunice Kawenda who came to the scene and upon sight of the court order, she then queried its authenticity prompting her to seek some clarification from the High Court Registrar.

Due to the facts established that there was a dispute, the police officer returned to the station without executing it.

Then on November 6, Diana Eunice Kawenda approached the High Court Registrar’s office and was told that the court order was indeed a fake court order.

Under court order 0433706 was a different case and on number HC 4001/23 was another case.

She then filed a report leading to the arrest of Phiri and Madyavanhu.

A man from Chitungwiza appeared in court over the weekend facing allegations of trying to defraud apostolic sect leader Lloyd Gwasira popularly known as Madzibaba Moses Gwanzura, his house that he is selling.

Nigel Mutambiikwa appeared before a Chitungwiza magistrate charged with fraud.

The State opposed his admission to bail on the grounds that he had supplied an invalid address.

Mutambiikwa said he lived in Murisa Park of which there is no area by that name in Chitungwiza.

Therefore, he was remanded in custody to November 30 pending verification of his residential address.

The  State alleged that at an unknown date to the prosecutor, Mutambiikwa and three others who are yet to be summoned before the court hatched a plan to defraud Madzibaba  Gwanzura after learning that he was selling his house in Manyame Park, Chitungwiza.

The accused persons manufactured a fake agreement of sale in which Mutambiikwa purported to have bought Madzibaba Gwanzura’s house.

His three accomplices were arrested at Madzibaba Gwanzura’s house when they were intimidating his agent with a pistol and handcuffs claiming that the house was theirs and producing documents pertaining to the house.

Mutambiikwa allegedly never filed a police report or provided evidence that he once bought the house in question for US$17 000 but could not possess it.

Madzibaba Gwanzura then filed a police report leading to Mutambiikwa’s arrest.

Mines and Mining Development Minister Zhemu Soda has today launched the fourth quarter gold mobilisation blitz to be carried out in five of the country’s 10 provinces.

The provinces are Mashonaland East, West and Central, Midlands and Matebeleland South.

In his remarks, Minister Soda said the gold mobilisation exercise was aimed at improving gold deliveries to Fidelity Gold Refinery and minimise leakages.

“The exercise is an audit to account for all stages of the gold production process in order to ensure transparency and accountability thus, decreasing illicit gold mining activities,” he said.
