HWANGE residents have called on the Hwange Local Board (HLB) to review its waste management by-laws to protect the environment from litterbugs.

Greater Whange Residents Trust chairperson Fidelis Chima said the current waste management by-laws were not comprehensive.

One would expect that the by-laws also address how to incentivise waste pickers. Most drinking places are littered mainly with empty beer containers because these outlets have no proper sites to dispose of waste,” Chima said.

“The other challenge is that the HLB waste management policy expired in 2016 and since then it has not been reviewed.”

Hwange Local Board spokesperson, Dumisani Nsingo, said the local authority was working towards updating the local environmental action plan.

“Our local environmental action plan needs updating but it does not mean that it’s not being updated. We are working towards updating it,” Nsingo said.

Some residents of Hwange recently staged a protest over pollution emanating from coal mining companies, saying their health was at risk.

OUTGOING Gweru Urban MP Brian Dube (MDC-T) has said the electorate should not expect miracles in their communities after voting for incompetent candidates in the upcoming general election.

Addressing a Gweru Residents and Ratepayers Association (GRRA) meeting yesterday,  Dube urged the electorate to guard against being hoodwinked by freebies doled out by candidates in the run-up to the August 23 poll.

“Let us be frank with each other,  it is folly for the electorate to expect miracles when they have chosen incompetent political leaders,” Dube said.

“People usually know the choices they make when they vote. But after making the wrong choices, they want to cry foul afterwards.

“If you choose to vote for beer or a packet of rice, that is what you should expect. There is no way, therefore, you can expect development in your communities after voting for freebies.”

Dube said as the country geared for the general elections, the electorate should watch out for flight-by-night politicians only concerned with lining their pockets at the expense of service delivery.

“Our biggest challenge is that people love politics more than their communities and development,” he said.

“The MPs and councillors we choose perform within their five-year term. So as we make choices we should prioritise what is important in our lives. Usually the level of development in a community comes with the mentality of that community, that is to say the community should be ready and determined to embrace development.”

Speaking at the same meeting, GRRA programmes officer Fadzai Kanyai urged people to set aside their political affiliations and vote for politicians who can deliver.

“As citizens we should move away from partisan politics to development-oriented politics,” she said.

“Let us choose representatives with capabilities.”

Over the years Zimbabweans have been known to vote along political lines despite the calibre of the chosen politicians.

As the world commemorates International Day in Support of Victims of Torture, the Zimbabwe Lawyers for Human Rights (ZLHR) has urged the government end torture and holding perpetrators accountable.

In a statement on Tuesday, ZLHR said all cases of torture must be investigated, including those involving members of the armed forces.“As an organisation dedicated to fostering a culture of human rights and seeking justice for victims of torture through litigation and other forms of redress,

ZLHR calls upon government to commit to eradicating torture by ratifying and domesticating the Convention against Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment,” ZLHR wrote.

“(The government should) criminalise torture and investigate all incidents and prosecute all cases of torture (as well as) ensure full accountability of all perpetrators and guarantee redress and rehabilitation to victims of torture.”

The International Day in Support of Victims of Torture is commemorated annually on June 26 in order to honour the victims and survivors of the crime of torture.

ZLHR called on the government to investigate all allegations of torture – including cases of excessive use of force by members of the security services – and prosecute those responsible. It also called for government should provide victims of torture with access to medical and psychological support.Meanwhile, the government of Zimbabwe is yet to ratify the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, despite signing it in 2019.

HIGH COURT judge Justice Pisirayi Kwenda has dismissed an urgent chamber application filed by property mogul George Katsimberis who was seeking to stop his fraud trial before Harare regional magistrate Vongai Muchuchuti Guwuriro, who he accuses of being biased and conflicted.

He wants the magistrate to recuse herself from hearing the matter and is also demanding the services of a Greek interpreter saying he is not conversant with the English language.

Katsimberis approached the High Court recently complaining that he would be prejudiced if the trial continues before his concerns are addressed.

After the magistrate dismissed his application for recusal, Katsimberis filed an application for review which is pending at the High Court.

In a brief High Court order, Justice Kwenda ruled: “Whereupon, after reading documents filed of record and hearing counsel, it is ordered that the application be and is hereby struck off with no order as to costs.”

Katsimberis is being represented by Advocate Tinomuda Chinyoka who is taking instructions from Mutumbwa, Mugabe and Partners.

In the fraud case, Katsimberis made an application for referral of the case to the Constitutional Court.

Katsimberis said Chinyoka’s health deteriorated prior to the February 14 hearing, prompting his stand-in lawyer Millicent Moyo from Mutumbwa Mugabe and Partners to seek postponement of trial.

A letter was delivered to the prosecutor stating that Chinyoka had travelled to South Africa for medication, hence the request for a postponement.

The magistrate, however, ruled that the trial should continue.

Katsimberis complained that proceedings were held in English despite that the Greek interpreter he had requested had not been availed.

Chinyoka later showed up during afternoon proceedings despite Moyo indicating that he had travelled outside the country.

This did not go down well with the magistrate who chastised the lawyers.

Moyo claims the magistrate tarnished her image and has taken the matter to court demanding US$290 000 damages.
