ERC Worried Over Safety, Organisation Of Constitutional Amendment Bill Public Hearings

The second day of public hearings on the Constitutional Amendment (No. 3) Bill (H.B. 1, 2026) was marred by localised security lapses, logistical hiccups, and procedural inconsistencies, the Election Resource Centre (ERC) has said.

In a statement released on Wednesday, 1 April, the ERC warned that these problems could undermine the credibility of the consultation process and discourage citizens from freely sharing their views.

The organisation said that for public hearings to be meaningful, they need to be conducted in a safe, well-organised, and transparent manner that allows everyone to participate without fear or hindrance. Part of the statement reads:

“Overall, the political environment on day 2 was not always conducive to the making of free and informed submissions at the public hearings.

“The atmosphere at the public hearings was tense and subdued but underpinned by palpable tensions.”

The ERC reported serious disruptions during public hearings on the Constitutional Amendment (No. 3) Bill.

At the Harare City Sports Centre, there were incidents of physical violence, including the assault of human rights lawyer Doug Coltart. Meanwhile, at Beit Hall in Mutare, observers noted a tense, coercive atmosphere, with signs of organised intimidation.

The ERC also highlighted a lack of coordination between Parliamentary Committees and the Zimbabwe Republic Police (ZRP).

This unclear division of responsibilities allowed unauthorised disruptions to continue unchecked, creating what the ERC described as a “chilling effect” that prevented citizens from participating freely in the hearings. It said:

“The ERC observed that, in several instances, perpetrators of violence were not promptly removed or held to account by onsite authorities, further damaging public confidence in the safety of the proceedings.”

The ERC noted that many attendees were unable to share their views, as time limits and large crowds meant only a small number of participants could make oral submissions. It said:

“While those selected to speak were generally given adequate time and were able to express themselves freely, concerns persist regarding freedom after expression, with increasing reports of victimisation and reprisals against individuals following their participation.

“Additionally, the absence of standardised and transparent criteria for selecting speakers from the floor created a risk of perceived partiality, thereby undermining meaningful participation.”

The ERC has urged the ZRP and Parliament to investigate the reported incidents and take the necessary steps to ensure a safe and conducive environment.

Advocate Mpofu Denies Claims He Took US$20 Million To Support “Agenda 2030”

Advocate Thabani Mpofu has hit back at journalist Reason Wafawarova following allegations that he and other prominent figures from Matabeleland received US$20 million to provide legal backing for ZANU-PF’s push to amend the Constitution.

The claims were made in a Facebook post by Wafawarova (Rizz Wafa), who alleged that Mpofu is part of a so-called “Matebeleland Cabal” working behind the scenes to give legal justification to ZANU-PF’s Agenda 2030. He wrote:

“Canaan Dube, Jonathan Moyo, Thabani Mpofu, Mbuso Fuzwayo, Nqobani Sithole and Method Ndlovu – The Matebeleland Cabal that has collectively pocketed $20 million for sanitizing and legally dressing Mnangagwa’s 2030 Term Extension Agenda.”

In response, Mpofu demanded that Wafawarova provide evidence to support his claims, warning that he would take action if he failed to do so. Mpofu wrote on X:

“In the interests of robust engagement and scrutiny, Mr Wafawarova must be encouraged to produce his evidence.

“He will obviously fail to do so because he is lying, and thereafter I will proceed against him.

“At the present moment, I can say this without impeding his ability to establish his case:

“Everything that Mr Wafawarova has said about me is not only false but also inane.

“This goes even for basic facts like my place of origin. I’m from the Midlands.”

Mpofu asserted that he has not been briefed by Dube at any point over the past eight years. He said:

“I have not been briefed by Mr Dube, maybe in some 8 years now. I have obviously been briefed by some lawyers from his firm over the years.

“The allegation that I was briefed to handle this term limit nonsense is therefore not only false but could not have been responsibly made by any journalist interested in telling the truth.

“I have put my life on the line in my fight against 2030. I fight on the frontline, and I fight with everything that I’ve got.

“Like most of you, I’m interested in knowing the real allegations against me. Mr Wafawarova has up to midday to pitch in.

“In the meantime, I must say this and trust to say it twice over; I absolutely detest both Mnangagwa and this 2030 agenda, which is fronted by dubious characters with whom I have been openly at loggerheads.

“I’ll differ with people on how to push back against Mnangagwa, but I’ll maintain my independence and will not let anyone tell me how to prosecute my protest.”

HARARE — Three constitutional advocacy organisations have formally withdrawn from the ongoing public hearings on the proposed Constitutional Amendment Bill No. 3, declaring the process a sham and announcing a coordinated citizen-driven campaign in its place.

Jameson Timba, convenor of the Defend the Constitution Platform (DCP), made the announcement at a joint press conference in Harare on Wednesday, flanked by veteran opposition leader Tendai Biti of the Constitutional Defenders Forum (CDF) and Professor Lovemore Madhuku of the National Constitutional Assembly (NCA).

The Bill, which has ignited fierce opposition across civil society, proposes a series of far-reaching changes to Zimbabwe’s constitutional order. Among its most contentious provisions is a proposal to extend the presidential term of office by two years, designed to keep President Emmerson Mnangagwa in power beyond 2028.

The Bill also proposes that the president be elected by Members of Parliament rather than directly by the people — a fundamental shift away from popular suffrage.

Other amendments would grant the president the power to appoint 10 senators, further consolidating executive control over the legislature. Opponents argue that taken together, the amendments represent a deliberate dismantling of the checks and balances enshrined in the 2013 constitution.

“This is not consultation. It is orchestration,” Timba said of an outreach by parliament to canvass public opinion on the planned amendments to the constitution.

He cited what he described as the systematic exclusion of dissenting voices, intimidation of citizens, and outright violence against those who sought to speak against the Bill.

“What we witnessed on March 31 in Harare, and indeed in other parts of the country, cannot be described as a genuine consultative process,” Timba said.

“Citizens were denied the opportunity to speak, voices were drowned out, and in some instances, violence and intimidation were deployed against those expressing dissenting views.”

The three organisations said they could no longer participate in or lend legitimacy to a process they described as “fundamentally flawed” and inconsistent with the spirit and letter of the constitution.

The March 30 to April 2 public consultations, which are non-binding, will culminate in a vote on the Bill by MPs, likely on May.

The groups were emphatic that their withdrawal from the hearings did not signal a retreat from the constitutional struggle. Timba announced that the DCP would establish a framework for lawful civic engagement anchored in Section 59 of the constitution, which guarantees the right to demonstrate and present petitions peacefully.

The platform, he said, would give citizens the ability to express their views freely, participate in organised civic action, and assert their constitutional rights.

The three organisations also issued a joint demand for a proper, comprehensive consultation process to be conducted in every constituency across the country.

The DCP, CDF and NCA announced they would establish a coordinated framework to act collectively in defence of the constitution. Timba said they would also be reaching out to a broader coalition of stakeholders, including the church and war veterans’ organisations.

“This is not about organisations,” Timba said. “It is about the people. It is about ensuring that the constitution remains a true expression of their will.”

The driving demand by the organisations is that the amendments be subjected to a referendum, which they argue is a constitutional requirement.
“We cannot legitimise a process that silences the very people it claims to consult. The constitution belongs to the people of Zimbabwe, and its future must be determined by them, not imposed upon them,” Timba said.

He called on all Zimbabweans to remain peaceful, vigilant and engaged, declaring that the defence of the constitution was now firmly in the hands of citizens.

IT is now clear beyond reasonable doubt that the current public consultation process by parliament is a fraud and a sham.

Across the length and breadth of the country, Zanu PF has carefully and methodically orchestrated a giant choreographed scam with the same basic structure and characteristics.

The first element has been the systematic use of violence and intimidation.

Across the country, known activists and democrats have been kidnapped, assaulted, or harassed.

In Chiredzi, Gilbert Mutebuki is fighting for his life, with his wife left terribly traumatised. He was refused the right to give testimony at the Chiredzi gathering. He was then followed, and his leg was literally cut. They left him for dead.

In Kwekwe and Mhondoro, the few who spoke against the constitution were followed up and assaulted. In Bulawayo, two youth leaders were assaulted and the Nketa meeting was prematurely abandoned.

The City Sports Centre in Harare on March 31 was a charade. As in all other places, thousands were bussed to the venue. The same crowd had been at Epworth in the morning.

They were fed fast food from Chicken Slice and Chicken Inn. They were made to sign hundreds of statements and affidavits, which they deposited in boxes provided by parliament.

Zanu PF was in charge. It was a youth chair who passed around the microphone – one who knew who to pick and what they were programmed to say. The message was the same orchestra of deceit.

“Allow the president time to complete his projects.”

But this is a man who has been in government since 1980. If he has not completed a legacy in 46 years, two more years will not help him.

“Elections are too divisive; we must concentrate on development.”

But it is regular, free, and fair elections that guarantee accountability and performance. In any event, this group has been in power since 1980 — they have nothing new to offer.

“MPs must elect the president, because South Africa does it.”

But South Africa employs a system of proportional representation, not first past the post — therefore its MPs carry a broader national mandate. Furthermore, the South African president does not enjoy the same imperial powers being granted to this president under the Constitutional Amendment No. 3 Bill, among them the power to appoint 10 senators.

It was painful to witness poor, marginalised and unemployed people being made advocates for those who are the very authors of their misfortune. The weaponisation and instrumentalisation of poverty and ignorance is a hallmark of authoritarian actors in dominated social formations.

Dictators across the world have systematically harvested the poverty and ignorance they themselves plant and nurture. Zanu PF has deliberately underdeveloped Zimbabwe as a means of reproducing its own power.

The intimidation and violence that played out at the City Sports Centre was surreal. The refusal to allow those in Bay 8 — where most democrats were stationed — to speak was pathetic and embarrassing. The assault on Doug Coltart was pre-planned and pre-paid. Some of us survived only due to the protection offered by fellow citizens.

There is no doubt that this process is intended to permanently muzzle and silence Zimbabwe. They are recreating a de facto one-party state. They have paid millions of dollars to destroy the democratic movement. But they seek to go further still — to turn Zimbabwe into a feudal monarchy: a Munhumutapa dynasty run and controlled by one family.

This ambition is ill-conceived and ill-advised. All it does is push Zimbabwe to the edge — to a point of no return.

The regime must understand that it cannot get away with its brazen, prehistoric agenda to seize power from the citizen. Citizens and the state itself will refuse and resist. The Munhumutapas — Kutamadzoka, Chigwangu, and others — will refuse this ahistorical abuse of the great Munhumutapa Empire.

It is not yet too late to withdraw this Bill. We urge its withdrawal.

The Zimbabwean government is working to repatriate four Zimbabweans who were fighting alongside Russian forces in Ukraine, while documentation challenges have stalled efforts to bring back others, government spokesperson Nick Mangwana has said.

Mangwana also confirmed that the number of Zimbabweans killed in the conflict has risen to 18.

“Trafficked to be a foreign fighter. The number of Zimbabweans killed in a foreign conflict is now 18. The State is seized with the repatriation of only four of those as there are issues around the documentation around the others,” Mangwana said on X.

His statement follows growing official concern over what authorities have described as a human trafficking syndicate luring Zimbabweans to enlist in foreign militaries under false pretenses.

In a significant breakthrough, four men accused of running a recruitment ring were arrested in Harare.

The four – Obert Hlavati, Tonderai Maphosa, Tanaka Malcolm Gwarada and Edson Dudzayi Nyamudeza appeared before Harare magistrate Jessi Kufa on human trafficking charges and were not asked to plead.

Prosecutor Oscar Madhume alleged that from last month, the four conspired with a Russian national identified only as Ivan to traffic six Zimbabweans to Russia.

Reports from Harare indicated the victims were recruited through social media platforms including Facebook, Telegram and WhatsApp, were they were told they would work as firefighters with lucrative salaries and favourable conditions.

Ivan referred victims to Gwarada, a local agent and InDrive taxi driver, who completed the recruitment process. Gwarada allegedly received US$8,167 at various intervals through Ecocash and a Bureau de Change at 5 Londonderry in Eastlea, Harare.

He then placed the victims in hotels, lodges and safe houses in the Harare central business district while they awaited completion of the recruitment process.

Gwarada reportedly handed over the money to Maphosa, who arranged food and accommodation.

Hlavati was tasked with making sure the men obtained travel documents and medical reports.

Nyamudeza, an airport official, allegedly helped the victims pass through Robert Mugabe International Airport without difficulty.

Upon arrival in Russia, the men were received by Ivan, who confiscated their travel documents. Instead of working as firefighters, they were drafted into fighting in the Russia-Ukraine war.

The victims alerted relatives in Zimbabwe, who then contacted police and the Department of Social Welfare is now making efforts to fly the men back home.

Last week, authorities received information that the quartet had recruited four more men who were due to travel to Russia.

Detectives intercepted the victims at Robert Mugabe International Airport, leading to the arrests.

The arrests came after CITE’s investigative journalism unit, exposed the recruitment of Zimbabwean civilians to fight for Russia, a story that prompted official acknowledgment from the government.

Presidential spokesperson, George Charamba, publicly acknowledged CITE’s role and expressed gratitude to the media house for bringing the matter to light, saying the organisation had “broken this story after painstaking investigative journalism”.

This was after Information Minister Soda Zhemu had confirmed that 15 Zimbabweans had died in the conflict at the time, marking the first official statement on the scale of local involvement.

The minister added that 66 others who were recruited are still alive, with authorities working to facilitate their return.

“The president has directed this government to act with urgency and resolve this issue,” Zhemu said.

He described the repatriation of remains as diplomatically and logistically complex but said efforts were underway. Zhemu added that the security cluster had been instructed to intensify investigations into the trafficking syndicate.

“Those who are trading in the lives of our citizens for profit will face the full wrath of the law,” he said.

The government has since warned Zimbabweans against enlisting in foreign militaries, describing emerging reports of citizens recruited to fight abroad as a form of human trafficking.

Authorities say they remain concerned about the safety of Zimbabweans who may be lured into conflicts under misleading circumstances.
